With over 15 years of experience in dealing with Costa Rica Realtors and Lawyers, assuming laws are similar throughout the World or that Realtors and Lawyers in Costa Rica are bound by similar ethical standards. . . WOULD BE A HUGE MISTAKE
Costa Rica is a beautiful and captivating Country and the local people are some of the most loving and generous people anywhere in the World. It can be a great place to purchase property for investment, vacation or retirement but it's imperative that you go into this with the right people on your team! In my experience those people are very few and far between in an industry that is virtually unregulated. Our hope is that we ALL WORK TOGETHER to inform one another of the GOOD GUYS and the BAD GUYS to make purchasing property in Costa Rica as wonderful as the Country! Costa Rica does not legally require real estate agents to be licensed, trained, or regulated by the government, allowing anyone to act as a broker. While no national licensing exists, reputable agents often join private associations like CRGAR or CCCBR for professional standards. All commissions are subject to a 13% VAT, and a public notary is required for legal closing.

Practicing law in Costa Rica requires a law degree (Licenciatura), registration with the Colegio de Abogados y Abogadas de Costa Rica, and passing a mandatory bar exam. Foreign-trained lawyers must have their degrees validated by a local university and pass ethics exams. The system is civil law-based, often requiring attorneys to also be authorized as Notaries Public to draft and authenticate documents. Key aspects of practicing law in Costa Rica include:

We are going to provide you with a broad overview of our experiences with hopes of giving you an understanding of a typical Real Estate transaction in Costa Rica. First and foremost, the Attorney you choose is CRITICAL and unlike most of the World, your Attorney could be involved in everything from property taxes, to income taxes, vehicle registration, notary services, etc. We unfortunately chose a CROOK and with over 25,000 practicing attorneys in Costa Rica that seems to be what we hear A LOT!
When purchasing Real Estate inevitably your agent will refer you to their Lawyer to draft all documents, etc. . . PROCEED WITH CAUTION! In our case the two were very close since they use each other to grow their businesses and neither could careless about our best interest or their obligations to "us" the client. Since we live in the US, my then Attorney requested that I provide his office with a POA or Power of Attorney to sign documents, etc. Thinking this made sense we signed over POA allowing my Attorney the same rights as ourselves "the property owners". NEVER NEVER NEVER SIGN A POA TO ANY ATTORNEY except for something very limited in scope and when there's no other way to accomplish that task. Virtually every Real Estate property in Costa Rica is put into a corporation. It is CRITICAL that you always maintain and have any and all updated copies of your corporate documents UPDATED ANNUALLY. We had put too much trust in our Attorney and to sum it up. . . . Our property was held ransom by our Attorney to the tune of over $50,000USD in order to get our corporate documents back which is necessary to sell the property. Trying to fight any of this in the Costa Rica Courts is painfully slow and very costly. Over my 15 years of experience, we are unfortunately not the exception but the rule when it comes to some of the shady legal practices with both Realtors and Lawyers in Costa Rica.
We wanted to design this site to not only help those better understand Costa Rica Real Estate and Law but also expose the EVIL WRONG DOERS and highly recommend the Law Firms and Real Estate agents that go above and beyond!!
